FORENSIC FIELDNOTE — TRUE THREAT ANALYSIS

M
Mark Randall Havens
|

Joel Johnson’s latest article is not art. It constitutes a “true threat” under Elonis v. United States (575 U.S. 723, 2015): a communication where intent to harm can be reasonably inferred.

By laundering violent fantasy through “fiction,” Johnson demonstrates consciousness of guilt — a recognized evidentiary marker (see United States v. Rajaratnam, 719 F.3d 139, 2d Cir. 2013).

This is not protected speech. It is evidence of malice, intent, and dangerousness — grounds for pre-trial detention.
